What are stamp duty and registration fee?

  • Stamp duty — the tax paid to the state for the deed’s validity. Without it, the deed is not acceptable in court as evidence.
  • Registration fee — the administrative fee for recording the deed at the sub-registrar’s office.

Both are a percentage of the deed’s value, and value means the higher of the two:

Example 2: a flat worth ₹40 lakh in Kolkata — Stamp duty 6% = ₹2,40,000 · registration fee 1% = ₹40,000 · Total ≈ ₹2,80,000

On top of this come separately: mouza-map fee, deed writer’s fee, stamp panel/e-stamp charge — which can run from a few thousand rupees upwards depending on the amount.

Where do I check the circle rate?

On the wbregistration.gov.in portal, the prevailing market value (circle rate) can be searched by district → block/mouza. Instead of relying on a broker’s mouth, match the rate against your dag’s class (shali/bastu) — bastu land’s rate is many times shali’s.

  • Gift deed within the family — between spouses, parents, children, siblings, gift deeds carry concessional stamp duty (much lower rate).
  • Correct class recording — writing the wrong land class in the deed and paying a higher rate is also a common mistake; have converted land recorded as bastu.
  • For loans — a bank mortgage deed’s fee is separate from a property purchase deed’s; if planning a loan, budget for both.

Recognise the broker traps

  1. “I’ll show a lower price” — deficient stamping: later fines + tax notices, trouble in loans.
  2. “Fake/spoiled stamps” — a deed written on unauthorised stamps doesn’t even register, and the money sinks.
  3. “You don’t need the fee receipt” — keep the receipt of every payment (GRIPS/challan) yourself.

  1. Determine the deed's value

    The purchase price vs the circle rate (prevailing market value list) — stamp duty is calculated on whichever is higher.

  2. E-stamping / stamp paper

    Buy e-stamp on wbregistration.gov.in or at authorised centres, or buy conventional stamp panels and arrange the deed's sections.

  3. Online slot booking

    Book the deed-writing date and the sub-registrar (SR) office's slot on the portal — tatkal-day arrangements also exist for urgent needs.

  4. Deed preparation and writer

    Prepare the deed through a licensed deed writer — mouza-map fee and writer's fee are separate; keep fee receipts to avoid fraud.

  5. Registration and witnesses

    On the appointed day, both parties + 2 witnesses present with photos get the deed registered with biometric verification; collect the receipt.
